In conversation with ‘Now is when‘, the criminal lawyer and crime expert, Francisco Cox, analyzed organized crime in our country, following the latest homicides and kidnappings recorded.

Regarding the situation of organized crime in Chile, Cox highlighted that “The focus has always been on drugs, when in reality what should be focused on is territorial control, on the ability of these gangs to articulate”adding that “The focus should not always be on the law”. Along the same lines, with respect to the articles on this type of crime considered in the constitutional proposal, he declared that “We have elevated the legal fetishism that because I put it in the law and now we elevate it to the Constitution, we are going to solve the problem”.

Continuing with the above, the idea of ​​creating a Supraterritorial Prosecutor’s Office, the criminal lawyer pointed out that “I think it’s a good idea”but believe “that constantly focusing on the fact that by adopting a law we are going to solve the problem, that does not solve it”. Therefore, that “fetishism” finally “it diverts the focus from the problem, which is the ability of our police to prevent, but not only that, but from the presence of the State in different territories”.

Finally, when asked about the interference of criminal gangs in the public apparatus, Francisco Cox maintained that “It is essential to maintain oversight”emphasizing that “Every time more powers are given to the police, the prosecutor’s office, whoever, more oversight has to be put in place”. At this point, he valued the work of the national prosecutor, Ángel Valencia, in making the information transparent.
