ELTA reminds that the officers of the Special Investigation Service (STT) started this investigation due to the 2014 auction for the sale of NPP assets. The aforementioned auction was held for 2 thousand. sales of tons of copper tubes contaminated with radioactive substances. Only two bidders participated in the auction. One of the participants, a company from Germany, won the auction and acquired the right to purchase the contaminated tubes at the initial price – more than 5 million. litas (1.5 million euros) or 2 thousand 700 litas (781.9 euros) per ton. At that time, the price of a ton of clean copper on the market was almost 5 times higher – about 13 thousand. litas (3 thousand 765 euros).
Although the winner of the auction was obliged to transport the purchased metal contaminated with radioactive substances from the NPP untreated, after the auction, a technological line for tube cleaning was installed on the territory of the power plant and the tube cleaning work began.
STT officials suspected that the winner of the auction was predetermined, and the transaction caused damage to the state, and a pre-trial investigation was launched. Accusations of abuse of office while operating in an organized group were brought against former general directors of IAE Darius Janulevičiis and Osvaldas Čiukšias, former head of IAE Commercial Department Laurus Puslias, authorized representative of a German company GB, director of a Lithuanian company KN and German citizen PZ Two of them, O. Čiukšias and L. Puslius was also charged with illegal possession of radioactive materials.
During the pre-trial investigation, STT applied to the Competition Council, requesting to assess whether the Competition Law was not violated during the organization and execution of the mentioned NPP auction. In December 2017, the Competition Council found that the two companies that participated in the auction only imitated the competition, having agreed in advance, and therefore awarded them 27,000 each for violations of the Competition Law. During the consideration of the civil case in court, the procedural position of IAE was changed, recognizing it as a co-plaintiff of the prosecution.
Panevėžys District Court in 2021 in May partially satisfied the claim – declared the mentioned auction invalid. However, the request to cancel the sales contract with the auction winner and subsequent additional agreements was rejected. The Panevėžys District Prosecutor’s Office appealed the decision of the court of first instance to the Lithuanian Court of Appeal.
On May 19, 2022, the Court of Appeal of Lithuania, after examining the appeals of the Panevėžys District Prosecutor’s Office and other participants in the process, stated that the court of first instance unreasonably invalidated the auction itself, and not its results, and unreasonably made a decision to preserve these transactions and not to apply restitution.
The appellate court made a new decision regarding this part of the civil dispute, which annulled the aforementioned contract and related agreements and applied restitution, awarding Ignalina nuclear power plant 89,000 from the defendant. 237 euros.
