The ‘friendly fire’ of FdI and Lega on the Musumeci anti-Covid ordinance

Time.news – ‘Friendly fire’ on the new ordinance of the president of the Sicilian Region, Nello Musumeci, which imposes a tightening on anti-Covid measures to avert the yellow zone. The first FdI and then also the Lega took sides against the Sicilian governor’s provision.

The ordinance provides for a reconnaissance of the unvaccinated population, fixed vaccination sites in municipalities with less than 60 percent of vaccinated people, obligation to use the mask outdoors if in crowded places, prohibition of access to public offices if without a green pass . And, again, the obligation of a swab to participate in ceremonies if the vaccination cycle has not been completed and a mandatory swab even for those arriving from the USA. Until 23 August, the ‘high risk area’ was established in Rosolini, in the province of Syracuse. “More than ninety percent of those hospitalized in intensive care – Musumeci underlines – concern people who are not vaccinated, very high numbers even in ordinary hospital wards”.

The reaction of the Brothers of Italy came first against the ordinance which will remain in force until 31 August. “While fully sharing the purpose of facing the advance of infections from Covid-19, we invite the President of the Region to specify more clearly, and if necessary also review, some of the measures envisaged in order to make their implementation more effective and certain” .

This is how the regional secretariat of FdI and the parliamentary group at ARS expressed themselves in a note, underlining that, in particular, “the provisions on public offices that limit access only to those who own the green pass and the definition of office must be clarified. public”. According to FdI, these provisions run the risk “of creating more inconvenience and confusion than concrete benefits in the sacrosanct fight against Covid and the shared need for an increasingly widespread vaccination among citizens to guarantee everyone” for which he trusts in the sensitivity of the president Musumeci who, like us, wants to stop the contagion with suitable and concretely effective measures, without adding other application uncertainties that unfortunately generate the sensation of discriminatory initiatives “.

Shortly after, the League arrived and defined the measure as “an act that seems to be the result of improvisation and which risks aggravating the already serious situation”. The regional deputies of the League criticize the Musumeci ordinance as “it appears largely inapplicable, as well as in other respects illogical and dangerous as a whole”. First of all, the prohibition of access to public buildings (starting from the regional ones) for those who do not have the Green pass – they argue – “is completely impracticable, given that public bodies (starting from the Region) are not equipped for checks, but it also appears completely illegal when it impacts on those offices (be they municipal, judicial, regional or public security offices) where physical presence is essential for the use of services “.

Not to mention the fact, according to the League, that many entities (starting with the Region) “are not equipped to provide their citizens with all services electronically”. In short, a provision “messed up from an administrative point of view”. Many problems then raise the obligation to pay for tampons aimed at the Green pass, which “has no legal basis and appears even more anomalous when public health – as evidenced by the immediate closure or reduction of the activity of the Drive -in – unable to provide service “.

The deputies of the League conclude: “While sharing the concerns about the progress of the epidemic, we can only worry about the solutions proposed by the regional government, which risk aggravating the situation and which seem to be the result of an unacceptable approximation”.

It was not long in the evening to take a stand in defense of the provision. “The facts speak for themselves, in Sicily as in the rest of Italy: 92 percent of hospitalized for Covid-19 are unvaccinated and contagions are in continuous and clear recovery. The latest ordinance of President Nello Musumeci takes note of all this and rightly introduces further measures to protect the health of Sicilians and to try to avoid a possible lockdown that would be harmful to the production sector. The free choice to undergo the vaccine or not, in fact, must never make us forget that our freedom ends where it begins the right to health of others “.

Thus Alessandro Aricò, group leader at the Ars di DiventeràBellissima, formation of the governing, after the criticisms of the Lega and FdI, who added: “The green pass was conceived by the national government precisely with the aim of guaranteeing the progressive return to normality with the lowest possible risk of contagion, is in its very nature to favor those who are vaccinated over those who do not. unpopular and to lend our side to disorganized and hypocritical political attacks, aimed only at seeking electoral consensus. We are firmly at the side of Nello Musumeci and strongly support the management of the Covid-19 emergency of the regional government and the Department of Health led by Ruggero Razza “.

The Privacy Guarantor asks for clarification

And on the prohibition of entry into public offices to those who do not have a Green pass, the Garlate della Privacy also intervened, sending a letter requesting clarification to the Sicilian Region and with the call to suspend “the effectiveness of such measures in the event that they have already been implemented”.

“The public health measures that involve the processing of personal data – recalls the Authority – fall within the matters subject to the reservation of state law and, therefore, they cannot be introduced with a regional ordinance, but only through a provision of primary rank, subject to the opinion of the Guarantor.

Furthermore, it does not appear that the most recent regulatory interventions on the subject of green certifications have required the display of these documents for user access to public offices or similar, so that their use for additional purposes and with methods different from respect the provisions of the state law would create an evident disparity of treatment at the territorial level “.
