With its decision, the government approved the position of the Republic of Bulgaria in case C-260/2024 of the Court of the European Union (CJEU), initiated by a preliminary inquiry by the Administrative Court – Sofia region. It is about the interpretation of provisions of European Union law related to the establishment of abuse of a dominant position through price gouging and the definition of a relevant market.

The inquiry is related to an appeal by “Lukoil Bulgaria” EOOD of a property sanction of nearly BGN 68 million imposed on the company by the Commission for the Protection of Competition (CPC). In Decision No. 184/16.02.2023 of the CPC, points out that the company has been sanctioned due to an established abuse of a dominant position by applying price pressure to the company’s competitors in the wholesale trade of motor fuels on the territory of the country, which can prevent, limit or distort competition in the fuel markets and affect the interests to users.

With its decision today, the government gives consent to enter the proceedings. The constitution of the Republic of Bulgaria as a party to the proceedings in this case will allow our country to successfully participate in the judicial process carried out by the CJEU, with a view to the uniform and accurate application of the law of the European Union.
