One of the novelties of the animal welfare law, which comes into force on Friday, is the obligation to have civil liability insurance for dog owners. But the general direction of the Ministry of Social Rights and Agenda 2030 has just announced that this precept will not be mandatory for the moment, until the regulation is appropriately developed.

In a statement, the general director, Sergio García Torres, explains that, although having insurance for all types of dogs, not only those of dangerous breeds, would be mandatory as of Friday, the 29th, in purity of legal terms is not actually applicable until the regulatory development of said precept occurs, in accordance with its provisions.

In relation to other obligations regulated in Law 7/2023, of March 28, that require regulatory development, such as the completion of the responsible ownership course or the identification of animals included in the positive list that are not dog species, cat and ferret, will be applicable once the aforementioned regulatory development comes into force.

Regarding insurance for dogs, the document ensures that, for the moment, the provisions on this matter in the regional and local regulations that establish, in some cases, the obligation to have civil liability insurance for dog ownership must be followed. .

Remember, however, that in the case of potentially dangerous dogs, the specific regulations require that the minimum insurance coverage be, at least 120,000 euros. The ministry recommends consulting insurance companies to advise on dogs that could be included in home insurance policies, according to their type, applicable regulations and other aspects.

Chaos in insurance companies

In recent weeks, insurers have experienced true chaos due to the uncertainty of hundreds of clients who wanted to know if they should insure their pets before this Friday or not. Juan Manuel Sánchez-Albornoz Gómez, president of the Galician Council of Insurance Mediators, recognizes that this issue has aroused a lot of interest in the insurance world, which is waiting for the regulations to establish the logical limits for contracting policies.

Until now, in the home policy you had the civil liability for pets covered, in most companies (except in the low cost) —explains Sánchez-Albornoz—. But By becoming mandatory by law, multi-line insurance excludes it. That’s where the problem will come.

For now, and although the ministry’s statement refers to regional and local regulations, the truth is that, to date – ‘as far as I know’, clarifies the president of the mediators – no autonomous region has legislated on domestic animals in general, although I know about potentially dangerous dogs.
