Resolution of the Council of Ministers No. 696 “On the use of individual objects of copyright and related rights” dated October 18 was published on the National Legal Portal.
This resolution is included in the development of the law dated January 3, 2023 “On limitation of exclusive rights to objects of intellectual property”.
This law allows the use of digital materials without the consent of the foreign owner, in fact it is the permission of piracy. Now the novelties of world cinema, which are shown in Belarusian cinemas, may be pirated copies. The law also allows the use of foreign computer programs without a license.
By its decree, the Government of Belarus determined how to form such a list of materials that are allowed to be used without the permission of the authors.
Proposals will be prepared by “organizations that are editorial offices of television mass media” and will be considered by the Ministry of Information.
It is noted that inclusion in this list will be based on the following criteria:
the right holder is a person from a foreign state who commits “unfriendly acts”; the right holder or ACU prohibited or did not give consent (permission) to the use on the territory of Belarus of an audiovisual work, the exclusive right of which belongs to him or the ACU; the use of an audiovisual work is necessary for “creating conditions for increasing the level of information security, and (or) developing the intellectual and spiritual and moral potential of society, and (or) providing access to the achievements of world culture and events of modern life.”
The resolution becomes effective after its official publication.
The Belarusian authorities consider the European Union countries, USA, Albania, Great Britain, Iceland, Canada, Liechtenstein, Norway, North Macedonia, Serbia, Montenegro and Switzerland to be unfriendly.
