At the table of the Prime Minister, Elisabeth Borne, were invited, a few hours before the start of the examination of the “immigration” bill in the National Assembly, the ministers Gérald Darmanin (interior), Olivier Dussopt (labor) and Franck Riester (relations with Parliament), as well as the presidents of the majority parliamentary groups, the rapporteurs and those responsible for the text.

Within this circle, Gérald Darmanin reiterates his conviction that“a compromise is possible” in the National Assembly; that the group Les Républicains (LR), chaired by Olivier Marleix, is “fractured” ; and above all warns that it is “out of the question of resorting to 49.3”.

The Minister of the Interior rejects the comparison with the pension reform, adopted without a vote eight months ago: “The situation is not at all the same, insists the tenant of Place Beauvau: the text on immigration is very widely supported by the French. » Elisabeth Borne, who announced in March that she no longer wanted to use 49.3 outside of budgetary texts, concluded the evening by in turn excluding forceful passage.

However, the government has no certainty, at this stage, of being able to avoid a new 49.3. Because the text adopted by the Senate at first reading, on November 14, at the end of a difficult negotiation between the right and the centrists, was toughened “in terms that are not acceptable to the presidential majority”denounces Sacha Houlié, president (Renaissance) of the law committee at the National Assembly, in West France. And the bill threatens to be largely rewritten by the deputies of the Macronist group.

“Our state of mind is to return to the government’s initial text”, warns the president of the Renaissance group at the Palais-Bourbon, Sylvain Maillard. Which would offer LR deputies good reasons not to vote for it. The bill will be examined in committee from November 27, then in the Hemicycle on December 11.

Clear the land

At the start of the dinner, Monday evening, Florent Boudié, rapporteur of the bill to the National Assembly, therefore warned the majority: “We cannot arrive by unraveling the Senate text. » The deputy (Renaissance) for Gironde, keen to clear the land, distinguishes three types of measures in the text adopted by a large majority at the Luxembourg Palace.

And first of all those relating to what he calls “black zone”provisions which will be deleted because they are considered to be “legislative riders”, and therefore run the risk of being rebutted by the Constitutional Council. This involves the abolition of state medical aid – which allows foreigners in an irregular situation to benefit from access to care – but also measures on land law – which fall under the nationality code – , or those concerning unaccompanied isolated minors.
