The House of Representatives unanimously adopts a bill amending the law relating to the Insurance Code

Rabat – The House of Representatives unanimously adopted, on Monday, during a plenary session, a bill amending Law No. 17.99 on the Insurance Code.

On this occasion, Naima El Fathaoui, member of the justice and development group at the origin of the bill, stressed that catastrophic events cause serious injuries and physical and psychological illnesses requiring long-term hospitalization, leaving victims in a state of incapacity, which prevents them from respecting the 20-day deadline set to notify the insurer.

To remedy this situation and give the insured the opportunity to notify the insurer, it was necessary to extend this period to 60 days in order to allow the insured to take the necessary steps to obtain the compensation provided for by law, she added, specifying that the system of coverage against the consequences of catastrophic events aims to compensate victims of direct damage occurring in Morocco whose determining origin is the action of abnormal intensity of a natural agent or the violent action of man.

Under this text, the deadline for notifying the insurer was extended to 60 days instead of 20 by providing for an article amending the provisions of Article 64-5 of Law No. 17.99 on the Insurance Code.

This article stipulates that “the insured is required to notify the insurer of the occurrence of any event likely to trigger the latter’s guarantee as soon as he becomes aware of it and at the latest within 60 days of said occurrence. This period cannot be reduced by a contrary agreement and may be extended by the Administration on the proposal of the Authority”.
