jpnn.comJAKARTA – Faisal Takwin, an anti-corruption activist from South Sulawesi stated his rejection of giving prosecutors the authority to act as investigators in certain criminal acts, especially in corruption cases. This statement was made following an examination of the material submitted by M. Jasin Jamaluddin to the Constitutional Court.

Faisal revealed that this granting of authority has the potential to create overlapping functions between the Prosecutor’s Office and the Corruption Eradication Commission (KPK).

“When prosecutors are given the authority to investigate, we risk blurring the role of the KPK as an independent institution in eradicating corruption. This can reduce the effectiveness of the KPK and create confusion in law enforcement,” said Faisal in a press release, Thursday (26/9).

He emphasized that this overlapping of functions could weaken the principle of checks and balances in the legal system.

“If prosecutors act as investigators and public prosecutors at the same time, it will be difficult to ensure the supervision necessary to maintain the integrity of our legal process,” he said.

Faisal referred to the opinion of expert witness, Jamin Ginting, who stated that the placement of prosecutors as investigators could cause bias in the supervisory function.

“We need a clear institutional structure in handling criminal acts of corruption. “The KPK must continue to function as an investigative body, while the Prosecutor’s Office and the Police have their own different roles,” he said.

Furthermore, Faisal emphasized that there is no article in the law that specifically gives authority to the prosecutor’s office as an investigator in corruption cases.
