Relatives of the social activist Facundo Molares Schoenfeld, militants of the Popular Rebellion Movement (MRP) and their lawyers warned that “There are many compelling elements to prove the crime” of the photojournalistwhose body was veiled this Friday afternoon, and they assured that he suffered a “suffocation” by members of the City Police that they “crushed him face down against the ground” and caused him a “cardiac accident” followed by death, during an operation to repress a protest in which he participated last Thursday at the Obelisk.

“The elements we have are many and forceful, they will allow us to prove the crime,” said one of the lawyers for the Molares family, Gustavo Franquetduring a press conference held at the headquarters of the Buenos Aires Press Union (Sipreba), located at Solís 1158 in the city of Buenos Aires.

As explained by the lawyer, the expert witness Fernando Mario Ariel Rossi considered that the autopsy of the body of Molares – which was veiled this Friday afternoon at the Asociación Mutual Sentimiento, at Federico Lacroze 4181 – is “absolutely compatible with suffocation”.

“Facundo was thrown to the ground, he was crushed face down against the ground. Two police officers weighing 100 kilos each got on him. The other people who were subjected to this treatment said they could not breathe” Gustavo Franquet

However, it also indicated that this autopsy, according to which Molares died of “congestion and edema, pulmonary hemorrhage-dilated heart disease,” is a report that “says nothing without the context” in which the death occurs.

“They threw Facundo to the ground, they crushed him face down against the ground. Two policemen weighing 100 kilos each got on him. The other people who were subjected to this treatment said that they could not breathe. Some began to say that Facundo was I was turning purple,” he explained.

Molares, 47, died on the afternoon of Thursday, August 10, a few meters from the Obelisk, after the repression by the City Police of a protest carried out by left-wing groups and social organizations called “against the electoral farce and for the democracy of the people”.

Franquet pointed out that the photojournalist died due to “the effort caused by the suffocation to which he was subjected, face down on the ground, which caused him to have a cardiac and pulmonary accident, something well indicated by the doctors”.

Regarding the versions that indicated that Molars had comorbidities that led to his death, Franquet argued that he “knows” his “clinical history” and affirmed that had “a condition” that caused him “breathing problems” but that He was not “at risk of a heart attack”.

“We renounce requesting a second autopsy in exchange for recovering Facundo’s body and being able to have it with us” Gustavo Franquet

The lawyer remarked that none of the consulted expertsboth from the Center for Legal and Social Studies (CELS), of the Human Rights Secretariat, and Rossi himself, questioned the autopsy and that, added to the procedures that his family went through to process the delivery of his body, they preferred to desist from “a second autopsy”.

“We renounced requesting a second autopsy in exchange for recovering Facundo’s body and being able to have it with us,” he added.

The agents who acted in front of the demonstration belong to the Urban Containment Operations Division (DOUC) and were under the command of police station 1-B of the Buenos Aires Policeas could be established from the National Criminal Correctional Prosecutor’s Office 30, in charge of the prosecutor Marcela Sánchez.

Prosecutor Sánchez, who is leading the investigation, ordered that the troops who participated in the operation be identified and entrusted the test measures to the Judicial Interventions Division of the Federal Police (PFA).

Asked if the police officers who participated in the events have been identified, Franquet stated that “not much has been done” so far and that “They only had access to the file on Thursday”.

“Precise information about the City Police has not yet been obtained,” he said.

“He was a guy who had a political consequence that we are not going to find anywhere in the State. Facundo is the most beautiful thing that the class struggle gave birth to in Latin America. Of course they needed him not to be there” Hugo Molares, Facundo’s father

His father, the justice of the peace in the Chubut town of Trevelin, Hugo Molares, and the militants of the MRP Lali Machado and Leonardo Juárez also took part in the conference.

“There is enough film and testimonial evidence, if they really want to administer justice, they can do it”Hugo Molares said about his son, whom he referred to as “a poet, a dreamer and a lifelong fighter.”

He also charged against the Buenos Aires head of government, Horacio Rodriguez Larreta and the Minister of Justice and Security of the City, Eugenio Burzacowhom he described as “miserable” and “intellectual authors of the crime”and that they “deserve to be prosecuted”.

“Both Larreta and Burzaco are the masterminds. There was no need to repress a group of 20 or 30 people who were already leaving. Facundo was smoking a cigarette and they attacked him. They attacked him viciously, it’s a cruel crime,” added.

Meanwhile, Machado indicated that there is “sufficient evidence” to verify that the death of Molares was “premeditated”, whom he did not decide to treat as “a victim” but as “a revolutionary.”

“He was a guy who had a political consequence that we are not going to find anywhere in the State. Facundo is the most beautiful thing that the class struggle gave birth to in Latin America. Of course they needed him not to be there,” he said.

On the other hand, Suárez added that the photojournalist “he was a man from another time” and that this explains why “a boy from the Buenos Aires suburbs goes to a fourth generation war like the Colombian war”, in reference to the 15 years in which Molares was part of the Revolutionary Armed Forces of Colombia (FARC).

“Time and perspective will give us another dimension of what this militant was,” he stressed.

The cause, labeled as “investigation of causes of death”is in charge of Judge Manuel Gorostiaga, of Criminal and Correctional Court No. 2, and who is instructing the investigation is the National Criminal Correctional Prosecutor’s Office 30.

Gorostiaga accepted on Thursday Hugo Molares as plaintiff in the case in which the death of his son is being investigated for being an “individual victim” in the facts.

“As a kid, I looked at the boys eating the garbage and said, why? People living on the street between cardboard, why does this have to happen?” Molares highlighted in a conversation with Télam – in the last note he gave to a medium-, when describing the argument that mobilized him to form part of an armed group like the FARC, which -he said- pursues “root changes”.
