A tragic turn of events in Israel has led to a legal battle over a real estate transaction that was supposed to have been finalized. The story began when a couple in Beer Sheva, who intended to sell their apartment, signed an agreement with buyers, who happened to be lawyers specializing in real estate. However, following the outbreak of war between Russia and Ukraine, the couple’s daughter in Ukraine did not sign the agreement, prompting the couple to cancel the deal and return the down payment to the buyers.

But things took a shocking turn when the couple were murdered in a terrorist attack just days before they were due to present their arguments in court. The buyers, however, demanded that the proceedings against the deceased couple be continued, leading to the matter reaching the desk of Judge Amit Cohen in Beer Sheva.

The court ruled that the only case that could be continued was that of the daughter’s, as the deal could not be enforced on both spouses without her signature. The buyers sought compensation, but the court ruled in favor of the daughter, stating that the agreement was not enforceable without her consent.

Judge Cohen emphasized that the agreement between the parties to meet for the purpose of signing a contract did not necessarily indicate an intent to enter into a binding contractual relationship. He noted that the wording of the document implied that the daughter had not yet given her approval and consent to the sale, thereby making the agreement non-binding.

The court’s decision, based on the contractual facts before it, favored the daughter, who was left with the apartment without having to pay any compensation. The plaintiffs were ordered to pay her trial expenses amounting to NIS 12.5 thousand.

In light of the court’s ruling, it is evident that even a signed agreement between parties may not be enforceable without the consent of all involved parties. The tragic turn of events serves as a poignant reminder of the complexities that can arise in real estate transactions, and the importance of ensuring all parties involved are in agreement before proceeding with a deal.
