The owner of a lottery store who changed his mind when the lottery ticket he bought for his friend at his request won first place, lost the case after a lawsuit. However, the real owner of the winning lottery ticket complained that he was having difficulty making a living because he had not yet received his winnings.

According to a report by Hong Kong’s South China Morning Post (SCMP) on the 28th (local time), Mr. Yao, from Xi’an, Shaanxi Province, northern China, who regularly purchased lottery tickets, gave 20 yuan (about 4,000 won) to Mr. Wang, a lottery store owner, on July 17, 2019. He asked me to send money (won) and buy two lottery tickets.

After receiving the request, Mr. Wang purchased two lottery tickets at random and sent a photo of the purchased lottery tickets to Mr. Yao for authentication. However, on this evening, one of the two lottery tickets that Mr. Wang purchased on behalf of Mr. Yao and sent a verification photo to at Yao’s request won the prize of 10 million yuan (about 2 billion won).

Mr. Yao was so excited that he went to Mr. Wang to pick up the lottery ticket he received in a photo, but was told something absurd. Mr. Wang claimed to Mr. Yao, “The winning lottery ticket was actually bought by someone else, but I sent you the wrong photo.”

Mr. Wang offered to give Mr. Yao 150,000 yuan (approximately 30 million won) in compensation for psychological damage and demanded that he delete all chat conversation records on his mobile phone. Mr. Yao accepted Mr. Wang’s suggestion, thinking that it was his fault to some extent.

However, two months later, Mr. Yao learned that the recipient of the first prize was Mr. Wang’s cousin, Mr. Gao. In fact, Mr. Gao received 8 million yuan (about 1.6 billion won) after deducting tax from the lottery winnings from the Shaanxi Provincial Lottery Management Center in September 2019.

An angry Mr. Yao filed a civil suit against Mr. Wang, claiming that he was the real owner of the winning lottery ticket. The Xi’an City People’s Court court ruled in October 2021 that Mr. Gao must return the first prize in the lottery to Mr. Yao, and that Mr. Wang must take joint responsibility for the winnings.

Accordingly, Mr. Gao objected to the first instance ruling and submitted an appeal to the court, but in July, the Xi’an Intermediate People’s Court confirmed the original judgment on the grounds that there was no evidence to support the fact that Mr. Gao had purchased a lottery ticket.

Mr. Yao told SCMP, “I won the lawsuit, but I am not happy. “I haven’t received a single penny from them,” he said. This is because the court froze Mr. Gao’s bank account, but there was no balance in this account. Their home was also put up for auction, but has not yet been sold.

Mr. Yao, a man in his 40s who works as a water deliveryman, earns only 3,000 yuan (about 600,000 won) per month. He said, “Until this incident, I lived a normal life. But I spent all my savings on this case. He also had to pay hundreds of thousands of yuan in attorney fees. “How can you not worry about your livelihood?”

Meanwhile, Yao’s lawyer said he plans to ask the court to investigate the whereabouts of the lottery winnings.
