Ministry Creates Working Group to Update Ordinance on Weapons Production Facilities
On August 9, 2024, the Ministry of Defense and the Ministry of Internal Affairs established a working group to draft changes to the Ordinance regulating the planning and design of constructions for the production, storage, and trade of weapons, ammunition, explosives, and pyrotechnic articles. This decision was reported by the Ministry of the Environment and Forestry.
The proposed changes address two key areas:
Safety distances: The text of Articles 15 and Appendix No. 6 of Regulation No. RD-02-20-1 will be amended to clarify the minimum safe distances for constructions related to weapons production to urban areas and existing structures.
Detailed development plans and building permits: The Ministry of Regional Development and Public Works issued clarifications regarding the authorities responsible for approving detailed development plans (PUPs), issuing building permits, and inspecting building permit compliance with the Law on Territorial Planning.
Detailed Development Plans (PUPs):
- PUPs outline the structure and development of settlements and their land, and are mandatory for investment design.
- Permission to develop a PUP is granted by a decision of the municipal council, based on the mayor’s proposal.
- The process involves coordination with relevant central and local authorities.
Building Permits:
- Building permits are issued by the chief architect of the municipality.
- Their issuance is based on compliance with the detailed development plan and related regulations.
Verification of Building Permits:
- Within 14 days of issuance, the National Construction and Construction Authority verifies the legality of building permits through an official check.
- This includes compliance with the detailed development plan, relevant regulations, and consultant reports.
