The affair in which the omission was revealed at the Assuta Hospital in Rasht’l was leaked to the media about a month ago. Among the sensitive and complicated legal issues that are now being discussed in the legal process – an issue that has never been discussed in Israel – what prevails in such a case of medical negligence: the genetic connection between the fetus and its biological mother or the physical connection to the pregnant woman the one who carries him, and this is when both biological parents have a genetic connection to the child while only the pregnant woman has a direct physical connection to the fetus. The biological parents want to verify through a genetic test that the fetus is indeed related to them, but the pregnant woman and her partner are against transferring the genetic information to a third party and are not willing to allow the test for reasons of privacy and confidentiality of medical information. Conducting the test requires their approval or a court ruling.
