The Municipality of Posadas, through Ordinance No. 304 in force until October, allows the regularization of buildings and the obtaining of the “Certificate of Completion of Work” to resolve problems that prevent the titling of horizontal properties. Engineer Marcelo Mazur, Secretary of Strategic and Territorial Planning, explained that this regulation opens a special and temporary window to regularize constructions with non-regulatory surfaces in their files. Municipal inspectors will visit the irregular units and will benefit 500 investors who bought in good faith.

Mazur mentioned that around 500 properties were detected in this irregular situation: “These properties cannot obtain the completion of the work because they have the regulatory surfaces and, therefore, they cannot do the titling of these functional units for the investors who bought these units.” At this point, he detailed that the areas with the highest concentration of irregular buildings are those “sections that have the highest concentration of high-rise buildings. We have section 1, 2 and 7.”

The engineer explained that the common irregularities found include constructions at heights not permitted: “Although a construction of up to 20 floors may have been authorized, they ended up building two more floors,” he said.

Regarding the previous procedure and the new framework established by the ordinance, Mazur said: “Before, when these surfaces were illegal, they were approved by way of exception in the City Council. What this ordinance does is regulate this situation, obviously with a surcharge for those who acted incorrectly in the sense of construction.”

As for those who benefit from this regulation, Mazur was clear: “This ordinance purely and exclusively benefits all investors who bought the functional units in good faith and who today are unable to obtain the title to the property.”

Regarding who should assume the costs of regularization, Mazur explained: “A group of municipal inspectors is approaching all these addresses informing the owners of the functional units and advising them that they have to speak with the developer, the construction company, the real estate agency that sold them the property.”

Finally, he stressed the importance of disseminating the ordinance: “The main purpose of this ordinance is to regulate irregularities and we have to try to inform all the owners who are in this situation.”
