“I think the prosecutor chooses the judge.”
Despite the decision not to participate in the group vote in the General Assembly,
Kim Sang-wook, Kim Ye-ji, Kyeong-tae Cho, Jia Han vote
At the plenary session on the 26th, the People Power Party protested against the fact that the motion to appoint Ma Eun-hyuk, political Gye-seon, and Cho Han-chang to the Constitutional Court, which were recommended by the National Assembly, was handled by opposition parties such as the Democratic Party of Korea, saying, “This is a serious issue that could invalidate the impeachment trial of President Yoon Seok-yeol itself.” The People Power Party held a general meeting of members prior to the plenary session on this day and decided not to participate as a group in voting on the appointment motion, but close (pro-Han Dong-hoon) lawmakers Kim Sang-wook, Kim Ye-ji, Kyung-tae Cho, and Jia Han participated in the vote.
Acting representative and floor leader Kwon Seong-dong said at the general meeting of lawmakers, “For the National Assembly, which is the prosecution for the president’s impeachment trial, to recommend a constitutional court judge to adjudicate the impeachment is the same as a prosecutor choosing a judge,” adding, “That also accounts for one-third of the total.” He said, “Recommending three of the nine people involved would greatly undermine the fairness of the impeachment trial.”
At the same time, he said, “If the appointment of the three Constitutional Court judges recommended by the National Assembly is recklessly carried out, the impeachment trial itself (of President Yoon Seok-yeol) may be invalidated.” Floor leader Kwon said, “When President Yoon was Prosecutor General, then Justice Minister Choo Mi-ae requested disciplinary action against Prosecutor General Yoon Seok-yeol and then appointed an additional disciplinary member. The Seoul High Court ruled that ‘the Minister of Justice who requested disciplinary action was not subject to disciplinary action. The court ruled that the appointment of a disciplinary committee member to review was a violation of constitutional due process and ruled that the disciplinary action itself was invalid.”
Floor leader Kwon met with reporters after the general meeting and said, “I maintained the position that Acting President Han Deok-soo does not have the authority to appoint judges of the Constitutional Court and did not attend the confirmation hearing. (Accordingly, we decided not to participate in the vote at the plenary session),” he said. “The members unanimously agreed. “But we didn’t go through the party consensus process,” he said.
However, close relatives of lawmakers Kim Sang-wook, Kim Ye-ji, Kyung-tae Cho, and Jia Han defied the decision to not participate and participated in the vote. Rep. Cho, who publicly stated that Acting President Han should be impeached, met with reporters and said, “There is no need to follow unjustified and cowardly party lines.”
Within the ruling party, since all four of them supported the impeachment of President Yoon, they are watching to see whether eight people will vote to leave when voting on the impeachment bill against Acting President Han. In this case, with 200 votes in favor, the ruling party’s raising the issue of quorum becomes meaningless.
