The Arbitration Court of Appeal of the Stavropol Territory dismissed the complaint of the Stary Istochny Water Company CJSC against the decision to recover compensation for the illegal use of the Essentuki trademark (owned by Testi LLC and Kavminkurortresursy JSC) without satisfaction, according to the court’s website.
“To leave the court decision unchanged, the complaint was not satisfied,” the message says.
RBC sent a request to CJSC Water Company Stary Istochnik.
In August 2018, copyright holders from the structures of Aqua Holding filed a lawsuit on the illegal use of the Essentuki brand on the packaging of mineral water. The owners of the appellation of origin of goods “Essentuki No. 4” noted that the competitor does not extract mineral water from the wells of the Essentuki field. They demanded that the products of the competitor “Rodnoy pump room No. 4, Essentuki – resort town” and “Stary source No. 4, Essentuki – resort town” be recognized as counterfeit.
