It was hoped that the disagreements between the ministries, the responsible Deputy Prime Minister Victoria Abramchenko and business over how the mechanisms for implementing the updated concept of extended liability of producers and importers for waste, proposed by the Russian Ecological Operator (PPK REO) and the Ministry of Natural Resources, are arranged (see Kommersant ”Dated July 12), will force the latter to reconsider at least the most problematic ones. As market participants told Kommersant, on August 17, at a meeting of the working group on ecology and nature management under the Administrative Reform Commission, where the draft law of the Ministry of Natural Resources and PPK REO was considered (see Kommersant dated June 9), representatives of the PPK (the main drafters of the document) convincingly explain the participants of the meeting, how the proposed innovations stimulate the reduction of waste generation, collection and processing of recyclable materials, could not – the objections of the market remained the same.

It should be reminded that the greatest misunderstanding among the economic bloc of the government and business is caused by the innovations proposed by the draft law, which give the PPK virtually absolute power over the collection and distribution of eco-collection funds (this should be paid by companies that have abandoned the EPR). Among them – the creation of a fund, replenished by the ecological collection and controlled by the PPK; the emergence from 2022 of a double standard for manufacturers of goods and packaging (for those who did not fulfill 100% of the recycling standard, it was proposed to double the payment, and for those who, for example, disposed of 10% of released goods and packaging, the remaining 90% also needs to be multiplied by two ); a ban from 2024 to the turnover in the Russian Federation of goods and packaging that are not accounted for in the GIS PPK being created, or the deprivation of the right of business to unite in associations directly in order to achieve recycling standards, and ultimately the impossibility of applying a reduction factor when using recyclable materials for the production of packaging (in PPK say they don’t understand how to check it). It is still unclear from the document how the PPK is going to achieve 100% waste utilization (and how it will be responsible for failing to achieve them), but the intention is clearly visible to increase the ecological collection up to 13 billion rubles. and spend them according to your ideas about what is good.

Earlier, on August 16, the document did not pass the face-to-face meeting of the working group on the implementation of the “regulatory guillotine” mechanism in the field of trade and consumer protection. But at the same time, 30 business associations (among them industry associations – from dairymen and confectioners to winemakers and electronics engineers – as well as the Association of European Businesses and Rusbrand) wrote a letter criticizing the bill addressed to Victoria Abramchenko. On the instructions of the curator of control and oversight activities and lawmaking in the government of Deputy Prime Minister Dmitry Grigorenko, today the Ministry of Natural Resources and the PPK must meet with business and remove contradictions.
