The President of the International Tribunal, Nawaf Salam, said in a press statement carried by the (INA): “The judicial consequences of political practices and their impact on the occupied territories are being examined by the court, and there are no limits to them. the freedom of the court to express its opinion regarding the extent of the contradiction between political practices and international law.”
He added, “It is within the jurisdiction of the court to express its advisory opinion regarding the occupation of the Zionist entity on the Palestinian territories, and that the occupied Palestinian territories represent lands whose unity, continuity, and sovereignty must be respected ,” indicating that “the court will study the judicial consequences of the illegal presence of the Zionist entity in the occupied territories, and the advisory opinion It is based on the assumption that the Palestinian territories are occupied lands.”
He said that “the Zionist entity has maintained its authority over the Gaza Strip, in particular monitoring its air, sea and land borders, and that the duties of the Zionist entity in the occupied territories are subject to the 1959 treaty regarding the treatment of civilians in times of war.”
He explained, “The Zionist entity has abandoned its obligations in the Treaty against Racial Discrimination concluded in 1965, and must abide by the Treaty of Sidra when it exercises its authority outside its territories,” at to note that “the Palestinian people have a right to self-determination recognized under the Oslo Treaty, and the practices of the Zionist entity after its occupation of the Palestinian lands in 1967 violated the right to self-determination.”
He continued, “The court believes that the occupation is a temporary situation due to military necessity, and that the continued occupation of the Palestinian territories for a long period of time does not change their legal status,” indicating that “it cannot the occupying authorities to displace the population of the occupied territories or some of their citizens occupy them, or move settlers to the West Bank.” West Jerusalem or East Jerusalem contravenes Article 49 of the Geneva Convention.”
He pointed out that “the retention of Palestinian property by settlers violates the international obligations of the Zionist entity, and it is the duty of the occupying forces to ensure that water and food are delivered to the residents of the occupied areas,” stressing that “established on the. the evidence we have, the Zionist entity has expanded the scope of its jurisdiction in the West Bank beyond local law, and is treating East Jerusalem as part of its territory.”
He pointed out that “the Zionist entity imposed its authority as an occupying force in a way that contradicts what is stated in Articles 53 and 64 of the Geneva Convention, and we consider that the inhabitants of the occupied territories were expelled from their lands. forced, which violates the obligations of the Zionist entity,” noting that “the Zionist entity has confiscated Palestinian lands and granted them to settlers, which is not temporary and violates the Geneva Convention.”
He continued, “The entity moved to establish new settlements in the West Bank, amounting to more than 24,000 settlement units,” stressing that “the court will later address the legality of the entity’s presence in the territories occupied.”
