President of the Supreme Court, Esther Hayutaddressed today (Tuesday) the three complaints filed against the Civil Service Commissioner following her speech against the Minister of Justice and Judicial System Reform.

“As the President of the Supreme Court, I saw it as my duty to express a position and voice the things I said at the opening session of the conference, in relation to the plan that the Minister of Justice presented at a press conference upon taking office. This, in view of the unprecedented consequences of this plan for the judiciary and the relationship between authorities the government in Israel,” Hayut wrote to the commissioner.

“Under the circumstances that arose and contrary to the claims made by the complainants, I do not believe that this was a violation of the rule set forth in Section 18 of the Ethics Rules, nor of the Civil Service Law (Classification of Party Activity and Fundraising), 1959, or of provisions 536.42 and 537.42 In my understanding and as stated above, these instructions do not apply to things that the President of the Supreme Court carries out by virtue of her position as the head of the system, and which are intended to protect the system from damage to its status as an independent and independent authority,” she added.

Later, the commissioner announced that he was rejecting the complaints. “I accept the words of the president in her response to the complaints, according to which she acted by virtue of her position, as the person at the head of the court system, in order to protect the system from any attempt to harm its independence and the ability of the judges, who are members of this system, to faithfully fulfill their duties as public servants.”

Five complaints were submitted to the Ombudsman for Judges against her speech. The complaints claim that the president violated the rules of ethics for judges by criticizing the government and the Knesset.
