In Azerbaijan, the procedure for issuing a referral for a medical and social examination for the purpose of assessing disability has changed.

As Day.Az reported on Tuesday, the corresponding decision was signed by Prime Minister of Azerbaijan Ali Asadov.

With the amendment, a new paragraph was added to the document.

According to the new paragraph, the commission refuses to issue a referral in the absence of the basic conditions specified in paragraph 1.5 of this Procedure, as well as if a person refuses to undergo the necessary diagnostic examinations in the cases provided for in paragraph 2.2 of this Procedure.

Please note that clause 1.5 provides the grounds for issuing a referral:

1.5.1. The presence of persistent physical, mental, intellectual or sensory impairments that prevent the recovery of impaired bodily functions and the person’s full and effective participation in society, despite the fact that the person has been receiving outpatient or inpatient treatment for the last 6 (six) months with the same the same illness without interruption or more than 6 (six) months with interruptions during the last 12 (twelve) months;

1.5.2. if a person has mental disorders and anatomical defects, drug-resistant forms of tuberculosis, stage IV cancer, stage V chronic kidney disease (the referral is issued without taking into account the period specified in subclause 1.5.1 of this rule);

1.5.3. if the violations, deficiencies and diseases specified in subparagraphs 1.5.1 and 1.5.2 of this Procedure continue after the end of the period of disability;

1.5.4. determination of the percentage of loss of professional ability to work;

1.5.5. if it is necessary to conduct a medical and social examination based on the conclusion of the Commission in connection with a change in the health status of a disabled person.

Clause 2.2 states that the Commission, no later than 7 (seven) working days (in the cases specified in subclause 1.5.2 of this rule, no later than 5 (five) working days) collects the results of medical examinations of a person, including extracts from his history diseases, and studies the results of treatment. When a person is referred to a specialized medical institution to clarify the diagnosis, this period is further increased to 10 (ten) working days.
