The Seventh Section of the Court of Seville has set the beginning of a new trial for Monday of next week, on another of the separate pieces of the macro-cause related to the irregularities of the venture capital company Invercaria, attached to the Innovation and Development Agency (IDEA) of the Junta de Andalucía, in this case for the participatory loans granted to the Jaen entity Bioaveda.

According to the indictment of the Prosecutor’s Office, collected by Europa Press, the trial is directed exclusively against the former president of Invercaria Tomás Pérez-Sauquillo, since in mid-May, the Fourth Section of the Hearing suspended the trial that was planned in against him for the participatory loans granted to the company of Mancha Real (Jaén) Electronics Devices Manufacture (EDM), for a value of 1.18 million euros; given his admission to a hospital for ailments related to the heart and prostate, for which he has undergone surgery.

THE BIOAVEDA PIECE

In this new piece, corresponding to Invercaria’s participatory loans to the Bioaveda entity, whose promoter has already passed away, the Prosecutor’s Office states that although in November 2008 Invercaria technicians pointed out “weaknesses” in the investment project in Bioaveda, such as its “weak image in the market” and “doubts about the patentability” of its products, among other aspects, Tomás Pérez-Sauquillo signed a participative loan of 90,000 euros in April 2009 “knowing the null capacity of the company to repay of the funds”.

The defendant, according to the Prosecutor’s Office, acted “failing to the most elementary management rules” of Invercaria and even as early as November 2009, despite knowing that Bioaveda “had not accredited the committed investments” for another 90,000 euros that had been granted. previously in 2006, “without competition” for it, “agreed to extend the maturity” of said initial loan.

Thus, the Prosecutor’s Office accuses the former president of Invercaria of an alleged continued crime of prevarication in competition with a continued crime of embezzlement, claiming for him six years and six months in prison and 20 years of absolute disqualification; as well as the obligation to compensate the Public Administration with 166,101 euros.

THE SITUATION OF PÉREZ-SAUQUILLO

Pérez-Sauquillo, let us remember, is sentenced to three and a half years in prison for prevarication in a contest with embezzlement for an arbitrary loan of 100,000 euros to the company Aceitunas Tatis, an extreme ratified by the Supreme Court; and he has also been sentenced to two years and three months in prison for the expenses of Invercaria’s personnel, to three years in prison for the participatory loan of 300,000 euros granted to the company from Jaén, Fumapa, and to the same penalty for aid for 1, 5 million euros granted by Invercaria to the company Cedes Electria.

However, his conviction for the loan to the Tatis company has been the first and so far the only one to be ratified by the Supreme Court, an end before which the First Section of the Seville Court determined his “immediate voluntary admission to prison”; to which his defense has alleged the serious illness he suffers, which in turn led the Prosecutor’s Office to request a forensic medical report and that the prison medical services determine whether the accused “may or may not carry his illness” in the jail.
