the Prosecutor asks for the trial – Corriere.it

by time news

A story of ancient grudges in which money is only one component, perhaps not even the main one. A family saga starring i Garavoglia, rich heirs of the Campari, one of the best known Italian brands in the world: on the one hand a brother and a sister; on the other, the sister excluded from the inventory of her mother’s estate with a declaration that could now cost the first two a trial.

Involved the uncle, the attorney and the notary

To ask for the trial the deputy prosecutor of Milan Stefano Civardi who accuses of complicity in false ideology Luca Garavoglia, 52, president of the Campari group, credited with a personal fortune of 5 billion dollars which places him in 689 place in the ranking Forbesof the richest in the world, his sister Alessandra, 61, 859 / a in the ranking with $ 4.1 billion, their uncle Michael the Great and their attorney Giovanni Berto, while the notary of Saronno (Varese) Carlo Munaf accused of omission of official documents. Aggrieved party Maddalena Garavoglia, 64, the eldest of the three brothers.

A divided family and the billions at stake

Since the mid-nineties the Garavoglia family has been deeply divided. In 1982 Davide Campari was bequeathed by the owner Angiola Maria Barbizzoli Migliavacca to the two managers Domenico Garavoglia and Erinno Rossi. Two years later, Garavoglia gained control of the company that had led to success, also involving his wife Rosa Anna Magno. In 1989 the spouses gave the bare ownership to their children. After the death of Domenico Garavoglia in ’92, relations between the brothers deteriorated and in 2000 Maddalena, accusing her of being ousted from Campari with a capital increase, sued Luca, Alessandra and her mother. Six years later he won the trial and got € 100 million in compensation. A fracture so incurable that in 2010 Rosa Anna Magno appointed only Luca and Alessandra his universal heirs, imposing that upon her death, Maddalena and her children were not allowed to enter the mortuary. In a document he wrote of family conflicts that have deeply embittered a long part of my life. He died in 2016, leaving behind $ 3.3 billion in assets.

The testamentary question and the lawsuit

Maddalena, having learned that the inventory of her mother’s assets had been made in 2017 in her absence by the notary, by the uncle (executor of her sister Rosa Anna’s will) and by the attorney who was acting on behalf of the brothers (who were absent) lawsuit assisted by the lawyer Giacomo Lunghini. With the investigations closed, the prosecutor Civardi now accuses the notary of not having warned Maddalena and Magno and Berto of having declared in the report that there were no other persons entitled to attend the inventory. Luca Garavoglia was also held responsible for not having indicated in the declaration of succession the presence of his sister Maddalena in the genealogical tree of the family and the relevant assets object of donation and liberality of the mother to all the heirs.

The inventory of the deceased’s assets

In the lawsuit, Maddalena Garavoglia declares that the inventory operations of the deceased’s assets lasted just 20/25 minutes and that the only legacies highlighted are three current accounts with just over 2.4 million euros, two securities policies for 2, 3 million, furnishings for 340 thousand euros and jewelery for 580 thousand. What the real size of the assets left by the mother is, she is unable to say because she has been deprived of any information for over 20 years, removed from the family home, unable to access that of her mother even after her death. In the inventory the safe would not be mentioned, which could not go unnoticed because it is practically an entire room in the 700 square meter house in the center of Milan. There would be no works of art, antiques and many period jewels of considerable value that the father used to give to his mother. He also knows that it existed a Swiss account on which the mother had received very large liquidity from her husband, she knows of 26 billion lire received by her mother on an Italian account of hers from finance companies of the Campari group and various usufructs.

The replica

Luca and Alessandra Garavoglia are sure they have operated correctly. Their lawyer, the lawyer Nerio Diod, declares that there have been other civil cases brought by Maddalena Garavoglia in the last two or three years on the succession of her mother’s assets all won by Luca and Alessandra Garavoglia. Therefore, I can only define this procedure as anything other than a brawl issue.
