The Prosecutor’s Office achieves a conviction against the former mayor of Breña for incompatible negotiation and embezzlement

The Fourth Office of the Second Corporate Provincial Prosecutor Specialized in Corruption Crimes of Lima officials, headed by Provincial Prosecutor Edwin Manrique Durand, obtained an eight-year sentence of imprisonment against the former mayor of the district of Breña, Ángel Wu Huapaya, for the commission of the crimes of incompatible negotiation and embezzlement.

The sentence includes former public officials Sergio Medina Valencia and Richard Loza Romero, and businessman Juan Miranda Carbajal, accused of the same crimes.

Likewise, the former mayor’s official, Óscar Zúñiga Ubierna, was sentenced to four years in prison suspended for the crime of incompatible negotiation.

According to the tax thesis, regarding the crime of incompatible negotiation, Wu Huapaya together with his accomplices, agreed to award the company ‘Consorcio Transmir’, the contract for the service of collection, transportation and final disposal of solid waste in the period from January 23 to March 18, 2015, without carrying out the procedure required for the provision of the service in said municipality.

The prosecutor’s office demonstrated the commission of the crime of embezzlement when it was verified that the company involved carried out work to collect waste in the streets of Breña with maintenance personnel from the aforementioned municipality, despite the fact that said work corresponded specifically to the “Consorcio Transmir”.

Those sentenced have been disqualified from holding public office, and must jointly pay the amount of S/ 63,1040.78 for civil reparation.
