As specified by the Office of the Public Prosecutor in a press release, specifically, the trigger for this action can be found in the massive reception by users of the Facebook and Instagram platforms of communications sent by Meta warning that the information shared on the aforementioned platforms (the publications , photos, photo captions, messages or questions on the website, among other examples) by the company to develop and improve its artificial intelligence.

In the background of the facts of the decree of origin, the prosecutor’s office explains that, in case users do not want Meta to use their content for this purpose, they must fill out a form called “objection request”, according to the prosecutor’s statement. office,” its shipment is difficult to locate and manage; and that, when it is filled out and placed, it will remain pending acceptance.”

For this reason, the prosecutor’s office “considers it necessary to carry out due diligence to verify the scope of the activities carried out by the company Meta regarding the use of personal data of users of the Facebook and Instagram platforms. ” To carry out these investigative works, the prosecutor’s office will work jointly with the Spanish Data Protection Agency.

“The acts are intended to promote the act of justice to protect the fundamental right of citizens to protect personal data, as well as to protect the rights of consumers and users of information society services,” supports the statement of the Ministry of Public.

With these works, the prosecutor’s office will try to indicate whether or not there is any indication of misconduct in Meta’s behavior. If he considered so, he would then have to present his conclusions before a judge, who would, accordingly, decide whether there was indeed sufficient evidence to open a case or not.
