Franco Vargas’ family gave their approval that this second autopsy will be performed under the Minnesota Protocol.
The Arica Guarantee Court accepted the request of the Public Prosecutor’s Office and authorized the exhumation of Franco Vargas’ body, conscript soldier who died on April 27, after an orderly march as part of his military service.
Judge Paulina Zúñiga Lira allowed the diligence considering that it does not put the success of the investigation at risk, but, on the contrary, “could provide background information for establishing the truth.”
This, after the Prosecutor’s Office stressed that Franco Vargas’ family gave their approval, since This second autopsy will be done under the Minnesota Protocol, which did not occur in the first expert report carried out at the time by the Legal Medical Service.
“The expert from the Public Criminal Defense Office is hereby authorized to participate in the exhumation of the body of the victim in this case, in the following sense: This expert will witness the exhumation of the body and will observe the procedure carried out by the expert appointed by the Public Prosecutor’s Office or by the expert from the Legal Medical Service in charge of this procedure. The external and internal examination of the corpse is authorized, as long as it does not affect the development of the procedure carried out by the expert from the Public Prosecutor’s Office or the Legal Medical Service; and the analysis of the samples obtained from this expertise is authorized,” instructed the magistrate.
Regional prosecutor Mario Carrera pointed out that a special team from the Homicide Brigade of the PDI Arica was formed to investigate this case and that Multiple investigative proceedings are being carried out, such as the taking of statements from all the conscript soldiers who participated in the training march where Franco Vargas died, in addition to the prompt completion of a new scene reconstruction procedure.
