Companies will be able to refer to the law to manage their employees on sick leave. Just before the second parliamentary elections, an order issued by the Attal government, which has now been resigned, explained how an employer can order a doctor to arrange a second visit to ensure that the employee’s suspension is in fact valid.

“It is an order that we expected more,” Matthieu Babin, partner in the law firm Capstan, spoke of “a big surprise”. Since 1978, the law provides that the employer can control work suspensions in the event that it covers the loss of the income of its employees by means of additional daily contributions paid by Social Security. This practice has not been specified by authority, however it is the case law of the Court of Cassation which has until now established the rules of the game.
