In its opinion, published on December 15, 2022, on the bill “relating to the Olympic and Paralympic Games [JOP] from 2024 »the Council of State had proposed to the government to add to this heading the terms: “And bearing various other provisions”. The text, adopted by the Council of Ministers on December 22 and which will come before the Culture and Law Committees of the Senate, from Tuesday January 17, has remained in its original name.

Through this proposal, the administrative judges had wanted to emphasize one thing about this project and its nineteen articles: it certainly aims to “adopt some additional measures necessary for the organization” of the JOP in the summer of 2024, as put forward by the government, but the field of « adaptations » the legislative provisions it includes (relating to safety, health, advertising, Sunday work, etc.) extends beyond this single event.

The JOPs constitute an opportunity for the executive to have a certain number of provisions adopted which are not limited to their duration – they will apply before the Games, as soon as the law comes into force, and afterwards in a sustainable – and which do not only concern the sporting field, but also cultural events or “recreational”.

“Eight articles are only applicable to the next Olympic and Paralympic Games in 2024, two of which are experimental”, identified the Council of State, adding that“eleven other articles create new provisions or modify existing provisions in a permanent way and will therefore be likely to apply to other situations”.
