At the beginning of the year, the Constitutional Court (SC) ruled with an interpretative decision that the mandate of the constitutional judges does not start from the moment of their actual election, but from the moment when the three different quotas had to be changed. The term of office of each person begins to run from the moment of the constitutionally required rotation in the Constitutional Court. Thus, Atanas Slavov from the PP-DB commented to BNT the decision of the Constitutional Court to declare partially unconstitutional the decisions on the election of constitutional judges Desislava Atanasova and Borislav Belazelkov.

“For me, this was an expected decision. It simply says that Mr. Belazelkov and Ms. Atanasova will not have a mandate of 9 years as it was written in the decision of the National Assembly, but with a mandate of about 7 years – as much as was left to complete the mandates of the previous constitutional judges. So there is no surprise for me. Rather, the Supreme Court consolidated its practice from the beginning of the year in interpretive decision No. 1 and from an old decision from 1994, where it is said that the Supreme Court itself cannot rule on issues related to the professional moral qualities of the elected constitutional judges. Both are confirmed in the latest constitutional decision,” explained Slavov.
