The Supreme allows Ence to continue in Pontevedra until 2073

The Fifth Section of the Contentious-Administrative Chamber has estimated the appeals filed by ENCE and eleven other entities against the judgments of the National Court that annulled the Resolution, of January 20, 2016, of the Director General of Sustainability of the Coast and the Sea, which granted ENCE a 60-year extension of the concession for the occupation of a strip of land maritime public domain for The pulp mill in Pontevedra, as reported by the Supreme Court after deliberating the matter this morning.

The Chamber considers that the concessions prior to the General Law of Coasts of 1988 can be extended, as is the case, provided there are favorable environmental reports. In the matter analyzed, there were favorable reports from the Administration in this matter.

In other appeals analyzed at the meeting on Tuesday, also related to the extension of concessions in the maritime-land public domain but referring to housing, the same Section has ratified the resolution of the Administration, also supported by the National Court, of deny the extension because in those cases the refusal was backed by unfavorable environmental reports. These were homes located on Babilonia beach in Guardamar del Segura (Alicante).
