The Supreme Court confirms the nullity of the provision under territorial monopolies of courses to recover driving license points

The Fourth Section of the Contentious-Administrative Chamber of the Supreme Court has confirmed the nullity of the provision under territorial monopolies of the courses for the recovery of driving license points, following the ruling of the Court of Justice of the Union Commission (CJEU), of January 19, 2023, which considered that the Spanish regulation of these courses is incompatible with Directive 2006/123/CE. The Chamber annuls both the resolution of the Central Administrative Court of Contractual Appeals of January 23, 2015 and the tender announcement of the General Directorate of Traffic “Concession of management of road awareness and re-education courses for the recovery of driving license credits”. …
