Chamber III of the Supreme Court has raised an issue of unconstitutionality of article 2.2 of Decree-Law 1/19, of February 22, of the Autonomous Community of the Balearic Islands, which establishes the obligation to reserve the service of VTC vehicles with a 30 minutes prior to their provision, due to violation of the regulated principle of freedom of enterprise recognized in article 38 of the Constitution. The Supreme Court explains that, in a ruling on February 13, it considered an article with a similar content in Basque Decree 200/2019 contrary to the constitutional right to free enterprise, which it annulled.
