The Supreme Court raises the sentence for continued sexual assault of a minor from 7 to 9 years in prison by lowering the mitigation and applying the new Law as more favorable

The Criminal Chamber of the Supreme Court has sentenced a young man to 9 years in prison for the crime of continued sexual assault with penetration of his 12-year-old cousin during two summers, in 2014 and 1015, in the town where the family vacationed. The court applies to the defendant the new Law that reforms sexual crimes because it is more favorable to the prisoner, since with the previous one the minimum sentence for these acts was 10 years and not 9. In the first place, the Supreme Court upholds the appeal of the private prosecution, on behalf of the victim’s mother, considering that the mitigation of undue delays was not very qualified, as had been established by the Audiencia de León, first, and the Superior Court of Justice of Castilla y León, later.
