The tenant sued – and lost: an owner of an apartment in the Krayot unexpectedly paid the security check

A resident of the Krayot filed a lawsuit in the Krayot Magistrate’s Court against the landlady, claiming that she had deposited a security check she had given her, for no reason. According to the landlady, the plaintiff left the apartment before the end of the contract, after an affair she had with her daughter’s partner was revealed, without paying her. This week the court dismissed the lawsuit.

According to the lawsuit, the tenant lived in the defendant’s apartment for two years. According to her, she left the apartment nicely and without any problems. Despite this, the landlord deposited a security check for NIS 5,000. This, she said, after she refused to hand it over to her on the grounds that she had sold it to the gray market.

In her lawsuit, she asked the court to order her to pay NIS 5,000 in compensation for mental distress.

In the written defense, the landlord claimed that the tenant left the apartment in a hurry a month before the end of the contract without paying her for it. This, she claims, after she caught her having an affair with the father of her grandchildren.

She further claimed that she left in the middle of the night and took with her a double mattress that did not belong to her and left the apartment dirty. She said she sent her a warning letter informing her that if she did not pay her debt, she would apply for execution.

The judge dismissed the lawsuit and ordered the plaintiff to pay the landlord NIS 500 for legal expenses. “The plaintiff has not proved any cause of action against the defendant. On the contrary,” she wrote in the judgment. “She did not leave a credible impression, to say the least, and in any case did not prove that the defendant had to return the check to her.”
