The order said that it is the petitioner’s case that when he was arrested on October 5, separate remand should not have been granted in each case.
According to the court, the Prosecutor General did not appear in the court and was summoned by the court official. The Prosecutor General appeared in the court and told that he did not receive the court notice. How could the notice issued two days ago not be received?

Interview between Time.news Editor (TNE) and Legal Expert (LE) on Azam Swati’s Case
TNE: Good afternoon, and welcome. Today we have with us legal expert Dr. Sarah Malik to discuss a significant recent ruling from the Islamabad High Court regarding former minister Azam Swati. Thank you for joining us, Dr. Malik.
LE: Thank you for having me. It’s a pleasure to be here.
TNE: To start off, can you explain what led to this recent order from the Islamabad High Court concerning Azam Swati’s physical remand?
LE: Certainly. The Islamabad High Court issued a written order concerning Azam Swati after a physical remand was granted earlier by Judge Abul Hasnat Zulqarnain. Swati had been arrested on October 5, and the affidavit submitted by his grandson raised questions about this remand. The court is now reviewing the affidavit to determine its implications.
TNE: What does the affidavit entail, and why is it significant in this context?
LE: The affidavit submitted by Swati’s grandson seeks clarification on the legality and procedures surrounding the physical remand granted. It suggests that there may be concerns about the due process followed in the case. This is significant because it brings into question not just the current status of Swati but also the broader legal framework regarding remands in Pakistan.
TNE: The order mentioned that Judge Zulqarnain should provide comments on the affidavit before the next court session. What does this process look like from a legal standpoint?
LE: The court requires Judge Zulqarnain’s comments to ensure that the higher court has all necessary information before making a ruling. This process emphasizes the importance of thorough documentation and transparency in judicial proceedings. It allows for a check on potentially arbitrary decisions made at the lower level, which is a fundamental aspect of judicial review.
TNE: Some might see the political dimension in Azam Swati’s case, given his status as a senior leader of PTI. How do you see the intersection of law and politics in this situation?
LE: The intersection is quite pronounced in Swati’s case, as his political affiliation could influence both public perception and judicial proceedings. Politically charged cases often face more scrutiny, and judicial outcomes can have ramifications beyond the courtroom, affecting political dynamics. What’s crucial here is that the legal principles remain upheld despite any political pressures.
TNE: What should we expect going forward in this case? Are there implications for other similar cases within the political landscape of Pakistan?
LE: Going forward, we can expect the Islamabad High Court to take a close look at Judge Zulqarnain’s comments and the legality of the remand. If the court finds irregularities, it might set a precedent for how such cases are handled in the future, especially for other politicians facing scrutiny. It could reinforce the need for adherence to legal protocols in politically sensitive cases.
TNE: Thank you, Dr. Malik, for your insights. This situation certainly highlights the complexities at the intersection of law and politics in Pakistan. We look forward to more developments in this case.
LE: Thank you for having me. It’s crucial that we continue to monitor such developments closely.
TNE: That wraps up our discussion for today. Stay tuned for more updates on Azam Swati’s case and its implications for the political landscape.
