The deputies agree to appoint a magistrate to hear appeals against minors linked to organized crime.

San Salvador. The Legislation and Constitutional Points Commission approved reforms to the Judicial Organic Law (LOJ), to regulate the integration of the Chambers Against Organized Crime.

With this, the Plenary Court may appoint a magistrate to hear the incidents and appeals against children and adolescents who are linked to criminal structures.

The president of the commission, Marcela Pineda, stated that “the resources or incidents are raised before resolutions and, in the original draft, it seemed that the resources were against people. Legally, the resources are not against people,” she reflected.

Members of these population sectors are covered by the Grow Together Law, and article 2 of the Juvenile Criminal Law states that minors under 12 years of age are exempt from criminal prosecution.

In this context, mentioning childhood and adolescence in these two regulatory bodies generates some legal conflict, therefore, the modification is made and the word “minors” is established.
