The District Prosecutor’s Office – Stara Zagora will prepare a protest against the ruling of the District Court – Stara Zagora dated 22.02.2024, issued at an injunctive hearing, to terminate the court proceedings on the indictment filed against Dimitar Kosev, 59 years old, the Appellate Prosecutor’s Office announced in Plovdiv.

Kosev was brought to court for the fact that on 11.11.2022 in the village of Buzovgrad, Kazanlak municipality, Stara Zagora region, while driving a passenger car, brand “Opel Astra”, he violated the traffic rules under the Road Traffic Act – Art. 20, para. 1, namely: “drivers are obliged to continuously control the road vehicles they drive”, and by carelessness caused the death of Iivan Sedmakov, 14 years old.

The act was committed in a drunken state – with a blood alcohol concentration of 1.6 per mille, duly established. Kosev fled the scene.

The reason for the court to stop the legal proceedings is in connection with the accepted concentration of alcohol in the blood, the prosecutor’s office also says. According to the court, the submitted indictment was drawn up in violation of the Criminal Procedure Code, as the indictment presented in it was not developed in a way that would allow the effective exercise of the right of defense, without giving more details. That is why he returns it to the prosecutor’s office to eliminate the violations of the procedural rules that he found.

The protest will be submitted for consideration in the Court of Appeal – Plovdiv in due time, after the District Prosecutor’s Office – Stara Zagora receives the required decision.
