Malaga, June 14 (EFE).- A man from Malaga with a pension of more than 2,000 euros has managed to get a debt of 88,322 euros forgiven after requesting loans to help a friend who was having a difficult time in her business and become the principal debtor as the economic situation did not improve.

For this reason, she took advantage of the Second Chance Law and has managed to have all her debts canceled after accumulating several loans to help a friend who could not meet the payments and whose monthly installments represented practically 70 percent of her pension. .

The Debt Assistance Association has reported this Wednesday that it has obtained this pardon for a resident of the Malaga town of Benamocarra who receives a pension of more than 2,000 euros per month thanks to what he enjoyed a certain debt capacity five years ago.

It was then that he decided to request loans to help some friends who needed liquidity in their business, but the situation of his relatives did not improve and the unpaid installments began to be claimed from him.

Despite his effort to pay everything on time, his personal and family expenses did not allow him to cover all the installments or the corresponding interest and late payment commissions, with which he entered into a succession of constant claims and recovery calls, which no longer It only affected his economy, but also his health.

The stress generated by the recovery calls added to the fear of having his pension seized led him to inquire about the Second Chance Law and sought advice from the Debt Assistance Association, whose lawyers confirmed that he met the profile to benefit from the debt cancellation procedure.

The first action carried out by the association was to notify the Commercial Court number 3 of Malaga of the insolvency situation of the debtor and began a period of joint negotiation with all the creditors. This already makes it possible to stop paying all your loans and credits, avoid any attempt to repossess and, consequently, an economic respite.

The lawyers proposed to the different entities a payment plan according to the possibilities of this citizen, which the creditors rejected.

Faced with this situation and notarially certifying that it is a bona fide debtor, the applicant gains the right to be forgiven 100% of his outstanding credits if he requests his bankruptcy, which was requested.

The court issued the final resolution granting the Unsatisfied Liability Exemption Benefit (BEPI), a ruling that leaves the associate’s creditors unable to collect anything at all and allows the ex-debtor to be excluded from any delinquency file.

There are already 115 exonerations from the Debt Assistance Association so far in 2023. EFE
