They revoke ruling that left Cárdenas without a lawyer

The lawyer Óscar Germán Latorre will once again be the defender of the former president of the Institute for Rural and Land Development (Indert) Justo Pastor Cárdenas, after the Court of Criminal Appeals, Fourth Chamber, revoked the resolution that declared the abandonment of the defending.

The chambermaids Arnaldo Fleitas, Bibiana Benítez and Andrea Vera admitted the appeal against the resolution of the Sentencing Court made up of judges Juan Carlos Zárate, María Fernanda García de Zúñiga and Yolanda Portillo, of last February 1.

They were to make the oral trial, in relation to the sentence, of Justo Cárdenas, for alleged illicit enrichment. That day, the lawyer Óscar Latorre presented a medical certificate of rest to justify his absence.

However, the judges declared the defense abandoned, because the certificate did not say where the lawyer Latorre was going to rest. This was appealed.

Latorre maintained that it was the first time that he had requested the suspension since he had rest, and that it was not a delaying strategy. The prosecutor Natalia Fúster agreed to the request of the defense.

The chambers point out that the certificate complied with all judicial requirements. In addition, they say that the obligation to put the address where the rest will be fulfilled is a requirement for the defendants and not for their lawyers. With this, they revoke the resolution and Latorre will continue in the defense.
