President Daniel Noboa sent his objections to the Law on the Eradication of Violence and Harassment in All Forms of Work. Assembly will process it after the vacancy.
President Daniel Noboa eliminated the figure that sanctioned disrespect for the worker’s digital disconnection, by partially vetoing the Law on the Eradication of Violence and Harassment in all types of work.
The President sent the text on the afternoon of this Wednesday, March 27, 2024, with eight observations on the project approved by the Assembly, which generated discomfort in the business sector. This is the content of the partial veto:
One of the sections objected to by Noboa indicated that workplace violence and harassment is not respecting an employee’s digital disconnection and rest time, as well as their vacations, personal privacy, and time with their family.
The president argues that there “the concept of workplace harassment is being distorted because digital disconnection is linked exclusively to teleworking contracts.” The scope of the reforms approved by the Assembly Furthermore, it points out that not all types of contact during digital disconnection, rest time, permits and vacations can be understood as workplace harassment.
Likewise, the veto eliminates the possibility for labor inspectors to issue financial sanctions in cases of workplace violence and harassment, because that power rests with the regional director.
The document will be discussed in the National Assembly, which went into recess from March 26 to April 9. Parliament has 30 days to agree to Noboa’s veto or ratify the original project, in which case it requires at least 92 votes among 137 legislators.
