“This is not the profile we hired”: Clermont requests the cancellation of his contract with Haouas

ASM Clermont Auvergne on Wednesday asked the Labor Court of Clermont-Ferrand to suspend the employment contract of player Mohamed Haouas, convicted of hitting his wife and who according to the club did not respect the “criteria of ethics and deontology of French rugby”.

The 29-year-old international pillar, who was to join ASM on July 1 for three seasons, arrived at the hearing with his wife in a car bearing the club’s logo. He did not wish to speak.

“Mohamed Haouas’ employment contract refers to the regulations of the French Rugby Federation and its charter” which asks players “to adopt exemplary behavior in all circumstances”, declared at the hearing Me Patrick Puso, lawyer for the ASM.

Beyond his conviction for domestic violence, the ASM believes that he was “deceived” by the player and his current club Montpellier on his “behaviour”, in particular his alcohol problems which earned him several visits to the police station, or silver. “This is not the profile we hired”, while Mr. Haouas has the duty to “respect the criteria of ethics and professional conduct of French rugby”.

As a result, the lawyer seized the industrial tribunal in summary proceedings to suspend his employment contract which is due to begin in July, before a hearing on the merits in September. The council will make its decision on Monday, June 26.

Me Puso argued “imminent damage” for the Auvergne club, referring to the departure of partners or the termination of subscriptions. In defense, Me Arnaud Dubois for his part denounced a “grotesque” situation. Mohamed Haouas is “not a product but a rugby player” who “we want to prohibit from working and feeding his family”, he declared.

“It was on the basis of his qualities as a professional player that he was poached by the ASM,” he added to the press. According to him, “it would seem unlikely that a labor court, a body set up to defend the interests of employees, decides that an employee does not have the right to work and no longer be paid while waiting for a judgment on the merits”.

“The Clermont club exonerates itself from its responsibilities as an employer (…) and asks the industrial tribunal to take a decision in its place. It is outrageous,” he added.

At the hearing, he claimed 390,000 euros as a provision for the “early termination of the employment contract” and 50,000 euros for non-pecuniary damage. Following the player’s conviction, the ASM announced that he could “not wear, on the field, the colors” of the club.

The pillar with 16 selections in the France team, tried in immediate appearance, was sentenced to one year in prison on May 30 by the Montpellier Criminal Court for hitting his wife in front of the shopping center where she works.

His sentence is flexible and his conditions will be discussed at a new hearing on Monday.
