jpnn.comJAKARTA – Coordinating Minister for Law, Human Rights, Immigration and Corrections Yusril Ihza Mahendra stated that the government respects the decision of the Constitutional Court (MK) which canceled the presidential and vice presidential nomination threshold requirements or “presidential threshold”.
This provision is contained in Article 222 of Law No. 7 of 2017 concerning Elections. The Constitutional Court considers this regulation to be contrary to the 1945 Constitution.
Before being cancelled, the provisions of Article 222 of the Election Law required that the candidate pair for President and Vice President must be supported by at least 20 percent of the seats of the political party or combination of political parties in the DPR RI, or a minimum of 25 percent of the valid national votes of the political party or combination of political parties based on the election results in the previous five years.
With this cancellation, every political party participating in the upcoming election has the right to nominate a candidate pair for President and Vice President without any further threshold.
“In accordance with the provisions of Article 24C of the 1945 Constitution, the Constitutional Court’s decision is the first and last decision which is final and binding,” said Yusril in a written statement in Jakarta, Thursday (2/1).
Yusril emphasized that all parties, including the government, are bound by the Constitutional Court’s decision without being able to take any legal action.
The government is aware that the request to test the provisions of Article 222 of the Election Law has been made more than 30 times, and only in this last test was it granted.
Furthermore, Yusril said, the government saw a change in the Constitutional Court’s attitude towards the constitutionality of the norms of Article 222 of the Election Law compared to previous decisions.
Yusril emphasized that all parties, including the government, are bound by the Constitutional Court’s decision without being able to take any legal action.
