The recent announcement of the cancellation of more than 34 Official Mexican Standards (NOM) related to health has generated a strong controversy. To date there are many doctors who affirm that it is a setback that will leave patients helpless. Similarly, others believe that it will have no effect on medical care. That is why it is worth analyzing both positions.

One of the first warnings about what would happen was given on November 29, 2022. The Undersecretary of Health, Hugo López-Gatell, was a guest at the morning conference at the National Palace. In his speech, he criticized the existence of the NOMs.

In his words, it is essential to renew the documents because they currently hardly cover the needs within the health field. He also stressed that constant updating must always prevail, both in people and in laws.

While on June 2, 2023, the cancellation of various health-related NOMs became official. The official himself released the news and added that these documents are not required to offer comprehensive and quality medical care.

But first, what are NOMs?

The NOMs are technical regulations of obligatory observance issued by the competent agencies. Their purpose is to establish the characteristics that processes or services must meet when they may constitute a risk to the safety of people or harm human health.

The NOM on Prevention and Health Promotion, once approved by the National Advisory Committee for Standardization of Disease Prevention and Control (CCNNPCE)are issued and published in the Official Gazette of the Federation (DOF) and, as it deals with health matters, they enter into force the day after their publication.

The NOM must be reviewed every five years from its entry into force. The CCNNPCE must analyze and, where appropriate, carry out a study of each NOM when its period expires in the course of the immediately preceding year and, as a conclusion of said review and/or study, it may decide to modify, cancel or ratify them.

For or against the cancellation of the health NOMs?

During the last days, multiple doctors and people related to health have published their opinion. According to the analyst Alfredo Alvarez Those affected will be both patients and institutions.

He mentions that now it will not be possible to sue government institutions for violations of the regulations because they no longer exist. In addition, there will be no guidelines for the minimum care for patients with cancer or diabetes, among other diseases.

On the other hand, the Dr. Mauricio Sarmiento makes a difference between theory and practice. In his case, he mentions that very few doctors actually read and applied them in their consultations. He also stresses that the real concern should be updating the health NOMs because there are many that were approved many years ago and are no longer useful today.
