Although the main problem is that there is still no real regulation in our country.

Based on all of the above, on February 27 the Health Commission of the Chamber of Deputies met to reform the General Health Law. The objective is to establish the bases to make the digital medical prescription a reality throughout the national territory.

Features proposed for the digital medical prescription

According to federal representative Éctor Jaime Ramírez Barba, the main points of this reform proposal are the following:

Medical prescriptions may be issued electronically, by health professionals legally authorized to do so.

In any case, the patient may demand the prescription in physical format, and the health professional or health institution in question will be obliged to deliver it.

The Secretariat must prepare, issue and disseminate the technical guidelines, policies and provisions of a general nature to guarantee the operation, security, authenticity and technical elements of the electronic medical prescription. For this purpose, the electronic medical prescription must contain, at least, the following:

I. The name of the patient;
II. The name of the health professional or of those authorized according to the current legal provisions;
III. The number of professional license or provisional authorization contemplated in the legal provisions in force;
IV. Contact details of the health professional;
V. Issue date;
SAW. Identification of the drug or product prescribed, generic name and if so desired by the issuer, may indicate it in its distinctive name, pharmaceutical form, quantity, dose, presentation, route of administration, frequency and duration of treatment;
VII. Electronic or digital signature of the issuer; and
VIII. Where appropriate, they must contain the specialty registration number, issued by the competent authority.

Pharmacies and establishments of the National Health System authorized to provide medicines and other health supplies must keep an electronic record of their dispensing of medicines and products prescribed in electronic medical prescriptions.

For this purpose, the Secretariat will issue general guidelines on:

I. The technological infrastructure necessary for said record to be kept electronically or digitally, guaranteeing its inalterability, accessibility, authenticity and integrity; II. Characteristics of the electronic or digital signature with which health professionals sign electronic medical prescriptions;
III. The development of technological means to promote access and rational use of medicines and health supplies.
