Everyone in Germany knows Til Schweiger’s films “Keinohrhasen” and “Zweiohrküken”. They are among the most successful films here. The Berlin regional court has now confirmed that the films’ co-screenwriter, Anika Decker, is entitled to more money.

The screenwriter of the successful films “Keinohrhasen” and “Zweiohrküken” is entitled to an appropriate share of the exploitation proceeds. However, the Berlin district court decided on Wednesday that the claims were largely time-barred. Anika Decker has thus achieved success with her lawsuit against the production company and rights holder Barefoot Films, whose managing director is Til Schweiger, and the media group Warner Bros. This applies to the years before 2015. According to a court spokeswoman, the author receives around 180,000 euros.

According to the ruling, the majority of their claims are time-barred. “She should have filed a lawsuit much earlier because she knew that the films were so successful in the cinema,” said presiding judge Rolf Danckwerts.

The judgment is based on the “fairness paragraph” in copyright law. It provides for additional payment if the originally agreed remuneration and the income subsequently achieved are noticeably disproportionate. From the court’s point of view, that is the case in this case. “Keinohrhasen” was the most successful German film in cinemas in 2008. “Two-eared Chicks” also later attracted millions of visitors. Decker and Schweiger wrote the scripts for both films together.

The legal dispute dragged on for years. In a so-called step-by-step lawsuit, Decker first demanded information about the income from the production company and the film company. Then it was about their financial demands. The regional court’s ruling is not yet final, but an appeal can still be lodged with the district court.

The German Screenplay Association initially reacted cautiously to the decision. “The situation of creative people is not such that we can immediately estimate success,” said managing director Jan Herchenröder. It is unfortunate that Decker, as the plaintiff, has to pay the entire court costs according to the judgment.
