Judge Francisco Antônio Alves de Oliveira, of the Court of Justice of the Federal District (TJDF), decreed to archive on Wednesday, 8th, the criminal action in which the former president Jair Bolsonaro (PL) was responsible for inciting the crime of rape against the federal deputy Maria do Rosario (PT-RS). The magistrate closed the case because the crime was already considered time-barred. During a discussion in 2014, the former chief executive stated that the deputy did not deserve to be raped and declared that she is “very ugly”. However, he only became a defendant in 2016, when the complaint was received by the Federal Supreme Court (STF). The process was suspended due to Bolsonaro’s election as President in 2018 and was only reopened after a request from the Public Ministry of the Federal District and Territories (MPDFT). The request was granted by 2nd Special Criminal Court of Brasilia. In his decision, the judge argued that “taking into account the date of receipt of the complaint, the period in which the process remained suspended (and the corresponding statute of limitations) and the maximum penalty imposed, of six months of detention, there is a occurrence of the prescription of the State’s punitive claim”. The former head of the Executive had already been ordered, in 2015, to compensate Maria do Rosário with R$10,000 for moral damages.
