Former US President Donald Trump, the Republican presidential candidate, has requested that his case be transferred from Manhattan Criminal Court to federal court ahead of his sexual harassment silence trial.

According to the New York Times (NYT) and the Washington Post (WP) on the 29th (local time), Trump’s attorney Todd Blanch filed the application, saying, “The ongoing process will cause direct and irreparable harm to President Trump, a leading candidate for the 2024 presidential election, and to voters beyond Manhattan.”

The case resulted in a guilty verdict in May, and sentencing is scheduled for September 18, seven weeks before the presidential election.

They argued that the court handling the case should be changed ahead of sentencing.

The New York Times (NYT) analyzed it as “a strategy to delay the court’s ruling.”

The defense argued that more time was needed to challenge the guilty verdict, citing Supreme Court rulings granting the president broad immunity from criminal action for official acts committed while in office. The court said the president is broadly granted immunity from criminal action for official acts committed while in office, even after he leaves office.

Earlier, the Trump camp asked Manhattan Criminal Court Judge Juan Merchan, who is handling the sexual harassment hush-money case, to postpone the sentencing of the related trial until after the November presidential election. Judge Merchan is expected to make a decision soon.

This isn’t the first time the court has requested a change of court. The Trump team made a similar request last year, but it was rejected.

The New York Times pointed out that “if the federal court does not grant Trump’s request, Judge Merchan will rule as before, so Trump’s efforts could backfire.”
