The former president of the United States Donald Trump formally requested this Monday the recusal of Judge Tanya S. Chutkanwhich investigates the case against the president for trying to overturn the result of the 2020 elections.
“Judge Chutkan, in relation to other (previous) cases, suggested that President Trump should be impeached and imprisoned. Such statements, made before this case began and without due process, are inherently disqualifying,” the former president’s lawyers have pointed out. The legal team maintains that, although the judge “may actually have the intention of giving” Trump a ” fair trial,” his “public statements inevitably taint these proceedings, regardless of the outcome.

Chutkan has been outspoken during the assault on the Capitol, calling the violence an assault on American democracy and warning of the future danger of political violence. In October 2022, during her sentencing, the judge criticized the accused Christine Priola for having offered “blind loyalty to a person who, by the way, remains free to this day.”
Trump has publicly criticized Chutkan before, stating that she “obviously wants me behind bars” and that she is “very biased and unfair.” The judge, randomly assigned to the case, has imposed harsh sentences on the January 6 defendants, matching or exceeding the sentences requested by prosecutors.
