Jair Bolsonaro

the minister Benedito Gonçalves
do Superior Electoral Court
did not accept a request from the defense of the former president Jair Bolsonaro
(PL) so that there is a new citation, this time in the United States, about a lawsuit in which he is investigated over the use of official palaces for campaign acts in the 2022 elections.

The magistrate argued that the formal communication made to the former head of the federal executive was valid. Bolsonaro’s lawyers aimed to prolong the progress of the action.

The citation is an attitude that is foreseen in the legislation to guarantee that an investigated person is officially communicated that he responds to a lawsuit in Justice. When the suspect receives the information, he can start his defense.

The TSE minister, who is the case’s rapporteur, pointed out that the act in relation to Bolsonaro was done in accordance with the law. The document was delivered to an address in Rio de Janeiro provided by the defense of the former ruler of Brazil.

Benedito also reported that the former president’s defense presented a defense in the inquiry “robust argumentation, which covers factual and legal aspects, and request for proof, being indicated a list of witnesses”.

“There is no doubt, then, that the piece constitutes a regular and substantial exercise of the right to technical defense”, he added.

The minister pointed out that formal communication needs to be respected and that “it is not possible to rule out its incidence by simple judgment of convenience of the defendant who declares (through his appointed lawyers) he intends first to receive the summons, in the United States, at an address not even declined , and only then meet with your legal team”.

The process

The inquiry is about the use of palaces in campaign acts by Bolsonaro. The action was presented by the coalition that supported the candidacy of President Luiz Inácio Lula da Silva (PT) in the last election.

The investigation officially began in January by decision of the Electoral Justice Inspector General, Benedito Gonçalves. It will be analyzed whether or not there was, within the law, the use of the Palácio do Planalto and Palácio da Alvorada facilities in the electoral campaign.

Bolsonaro’s lawyers deny that the former president used the presidential buildings for political acts.
