Two cases have been initiated in the Constitutional Court, related to the restrictions established by law. In one case, it is a matter of the provisions of the law, which provides for a ban from January 1, 2025, on the market of tobacco substitute products that contain any flavorings, except flavorings that produce the smell or taste of tobacco, and whose maximum nicotine concentration in the tobacco substitute product exceeds four milligrams per gram. The applicant is a capital company whose commercial activity is the import and distribution of tobacco substitute products – tobacco-free nicotine pads – in Latvia.
In the second case, the commercial activity of the applicant is related to the organization of gambling. The disputed norms stipulate that from January 1, 2025, smoking will be prohibited in places where gambling is organized.
In both cases, we are talking about the same law – the law of January 11, 2024 Amendments to the Law on the circulation of tobacco products, herbal smoking products, electronic smoking devices and their liquids –, the only difference is which articles the application is for. In both cases, the Constitutional Court has set the same deadlines for the Saeima – it should submit a response to the Constitutional Court by October 28, 2024, with an outline of the factual circumstances of the case and the legal justification. The deadline for the preparation of both cases is January 26, 2025. The court decides on the type and date of the case review process after the case is prepared.
In the case of flavored tobacco substitute products, the applicant is a capital company whose commercial activity is the importation and distribution of tobacco-free nicotine pads in Latvia.
